Burkina Faso, Mali, Niger Exit International Criminal Court

According to ICC regulations, a country’s withdrawal takes effect one year after official notification is submitted to the United Nations Secretary-General.

Military-led governments of Burkina Faso, Mali, and Niger have announced, on Monday, their decision to withdraw from the International Criminal Court (ICC), accusing the tribunal of acting as an instrument of imperialist influence over African nations.

In a joint statement, the ruling juntas in Bamako, Ouagadougou, and Niamey described the Hague-based court as “a tool of neo-colonial repression in the hands of imperial powers.”

They further asserted that the ICC has repeatedly failed to effectively prosecute war crimes, crimes against humanity, genocide, and crimes of aggression.

The three governments indicated their intention to establish “indigenous mechanisms for the consolidation of peace and justice” as an alternative to international judicial intervention.

The announcement represents a further step in the strengthening alliance of the three coup-led administrations, collectively known as the Alliance of Sahel States (AES), which have increasingly distanced themselves from Western influence, particularly from France.

Since the series of coups between 2020 and 2023, the nations have gravitated closer to Russia, whose President Vladimir Putin has been under an ICC arrest warrant since March 2023 in relation to the war in Ukraine.

Burkina Faso, Mali, and Niger continue to face significant jihadist insurgencies connected to Al-Qaeda and the Islamic State, resulting in thousands of deaths and the displacement of millions of people.

Meanwhile, their security forces have also been accused internationally of human rights abuses against civilians.

Established in 2002, the ICC is mandated to prosecute the most serious crimes, including war crimes, crimes against humanity, genocide, and crimes of aggression, particularly in cases where national courts are unable or unwilling to take action. – R
